This information is provided pursuant to Article 13 of Regulation (EU) 2016/679 (“General Data Protection Regulation”, hereinafter referred to as the “Regulation”) as well as pursuant to Recommendation No. 2/2001 adopted by the Working Party established by Article 29 of Directive No. 95/46/EC, and we wish to inform visitors of the site about the use of personal data entered or left behind when browsing.
By using any of our services and/or accepting this Policy, you consent to the collection and use of your Personal Information as described below.
This Policy is provided only for the website owned by the PERMANENT SECRETARIAT OF THE PELAGOS AGREEMENT (hereinafter also PELAGOS) at www.pelagos-sanctuary.org, not also for other websites that may be consulted by the user through links.
DATA CONTROLLER
The data controller is the PERMANENT SECRETARIAT OF THE PELAGOS AGREEMENT with registered office at Tour Odéon B1 36, avenue de l’Annonciade – MC – 98000 Monaco.
PLACE OF DATA PROCESSING
The processing operations connected to the web services of this site take place both at the registered office and at the operational offices. Data processing is carried out only by personnel in charge of processing, both internal and by any external persons in charge of occasional system maintenance operations.
No data deriving from the web service is disclosed or communicated to third parties, except for technical requirements or requests by the Judicial Authorities, as explained below.
PROCESSED DATA
PELAGOS collects personal data through the site when the form relating to the donation is filled in, the form relating to the adhesion of the code of good conduct (Pelagos Ambassador) is filled in, or communications are sent by e-mail to the address on the home page.
Personal data means any information concerning an identified or identifiable natural person with particular reference to an identifier such as a name, an online identifier or one or more characteristic elements of his physical, physiological, psychological, economic cultural or social identity.

Navigation data
The computer systems and software procedures used to operate this website acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected in order to be associated with identified interested parties, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes the IP addresses or domain names of the computers used by users who connect to the site, the URI (Uniform Resource Identifier) notation addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error….) and other parameters relating to the user’s operating system and computer environment.

Through the site you have the possibility of voluntarily leaving certain data such as your name, surname, and email address, through the form on the “DONATE” page or by forwarding an email message to the address on the site.
PELAGOS will process these data in full compliance with the regulations, assuming that they are referred to you or to third parties who have expressly authorised you to provide them on the basis of a correct legal basis legitimising the processing of the data in question.

PURPOSES OF DATA PROCESSING
- Purposes of responding to requests for information, including those sent by email to the contact indicated on the site.
- Purposes relating to the performance of a contract to which the user is a party, such as a donation by you. The legal basis is the provision of a service or response to a request and does not require consent. It does not involve the processing of personal data.
- Purposes relating to legal obligations to which PELAGOS is subject, such as the administrative handling of the donation. Legitimate processing within the meaning of current legislation.
- Purposes necessary to ascertain, exercise or defend a right in court. Legitimate processing under applicable law.
- The processing of the data for the above purposes is necessary: without it, it will not be possible to fulfil the requests of the user.
- Purposes arising from the sending of the Newsletter for which the explicit consent of the user will be collected.
RECIPIENTS OF DATA
No data deriving from the web service (i.e. navigation data specified above and cookies) is communicated or diffused (except for communication to judicial or police bodies if necessary). The data are processed by staff specifically appointed to process the data (administrative staff and public relations staff, including those external to the Company). They may also be processed by data processors designated pursuant to Article 28 of the Regulation (e.g. providers of development, delivery and operational management services for the technological platforms used). External companies may also process the data through specially appointed persons who may carry out the same activities and process the data for the same purposes for which the data processors have been appointed by the Data Controller. The data provided by the user may be communicated to parties for whom there are an obligation to communicate in accordance with the law or a need for communication in order to assert a legitimate right of the company before the competent authorities.
RETENTION TIMES
PELAGOS will process the user’s data for as long as is strictly necessary to achieve the above-mentioned purposes and ensures that the electronic and paper processing of the data by recipients is carried out in compliance with the regulations.
The User can, at any time, request the interruption of the Processing or the cancellation and/or limitation of the data.
TRANSFER OF DATA
The data controller does not transfer personal data to third countries or international organisations.
RIGHTS OF THE DATA SUBJECTS
The data subjects have the right to obtain from the Data Controller access to and rectification or erasure of their personal data or restriction of the processing concerning them, or to object to the processing (Art. 15 et seq. of the Regulation). Therefore, please consult the page often, taking as reference the date of last modification indicated at the bottom. If you do not accept the changes made to this privacy policy, you must cease using this website and you may request the Data Controller to remove your Personal Data, unless otherwise specified.
